According to the Cuyahoga County prosecutor’s office, The November 2014 shooting death of the Black child has been considered “reasonable” because of Rice’s possession of a toy gun and officers Timothy Loehmann and his partner, Frank Garmback assumption that the 12-year-old boy would be a threat to them.

On CNN.com’s  coverage of the story, Subodh Chandra–an attorney for the family of the slain Tamir Rice–has stated that the Rice family has demanded that the officers be held accountable, but feels that the prosecution isn’t aggressively advocating the accountability of the two cops.

“Any presentation to a grand jury — without the prosecutor advocating for Tamir — is a charade,” Chandra said. “To get so-called experts to assist in the whitewash — when the world has the video of what happened — is all the more alarming.”

The November 2012 murder of two Melanoid car passengers– Timothy Russell and Malissa Williams –occurred after the vehicle that Mr. Russell was driving at the time, backfired, which the officers claimed were gunshots. This justified their reasoning for killing the two passengers, who were later found to be unarmed. The newly acquitted cop, Michael Brelo, stood on the hood of the vehicle and shot a minimum of 15 shots into the car’s front seat, which inevitably took the lives of the unarmed Russell and Williams.

The firing of 15 shots took place after the officers had already shot the vehicle a whopping 137 times, with each of the passengers being struck at least 20 times each.

The 12-year-old child had a toy BB gun with the orange safety indicator removed. According to witnesses, the boy was in the playground area of the center, playing with the toy gun and allegedly pointing it at people.

In a 911 call released by the police, a man reported that “a guy” was pulling a gun out of his pants and scaring people, but the caller said twice that the gun was “probably fake.”
“There is a guy with a pistol,” the caller said. “It’s probably fake, but he’s pointing it at everybody.”

The shooting happened about 3:30 p.m. at the Cudell Recreation Center on the city’s west side, officials said. Deputy Chief Ed Tomba of the Cleveland police said on Saturday that the boy had not threatened the officers or pointed the weapon at them.
